Abstract:

Consistent with the law of delimitation the determination of the relevant area is a quintessential exercise for the purpose of delimiting overlapping entitlements to the continental shelf. It is a requisite for so doing to identify the relevant baselines for the purpose of the delimitation, at least in so far the basis of the entitlement is the coast. Notwithstanding the fact that there is only a single continental shelf in international law, the established methodology to identify the relevant area in delimitations of overlapping entitlements not extending 200 nautical miles from the baselines cannot be transposed to determine the relevant area in delimitations in which the overlapping entitlements are beyond such distance.
