Abstract:

This article discusses the possible limitations of the ICTR jurisprudence. It acknowledges the positive contribution of ICTR jurisprudence in the development of international criminal|and humanitarian law. Nevertheless, the article submits that where a judgement is arrived at by a majority of the bench, and there are persuasive dissenting opinions, national courts or international courts/tribunals should carefully reflect on it before adopting that decision or judgement
