Abstract: 

As in many other African nations, Somalia exists in a state of legal pluralism where customary law (Xeer), religious law (Sharia) and secular law operate. Among the three, Xeer is the dominant system that governs societal relations and serious crimes, due to a variety of historical and political reasons. Its persistence through years of civil war was primarily due to its core position underpinning the legitimacy of Somali traditional structures, especially in the provision of justice and arbitration, as first the Somali state and then society fractured.
